Members Agreement and Terms

  • “O T H E R  A G R E E M E N T  T E R M S”

    PARTIES TO THIS AGREEMENT. This Agreement is solely between you and the”
    “Seattle Fitness Group dba The Seattle Gym (the “”Club””).”

    MEMBERSHIP CANCELLATION.
    3-DAY CANCELLATION RIGHT. FOR THREE BUSINESS DAYS AFTER YOU SIGN THIS AGREEMENT, YOU MAY CANCEL IT FOR ANY REASON, WITHOUT PENALTY, BY MAILING WRITTEN NOTICE OF CANCELLATION, YOUR MEMBERSHIP CARD AND YOUR COPY OF THIS MEMBERSHIP AGREEMENT DIRECTLY TO THE CLUB AT THE ADDRESS NOTED ABOVE. YOUR CANCELLATION NOTICE MUST BE POSTMARKED ON OR BEFORE THE THIRD BUSINESS DAY AFTER THE DAY YOU SIGN THIS AGREEMENT. IF YOUR CANCELLATION IS TIMELY RECEIVED ALL AMOUNTS YOU HAVE PAID UNDER THIS AGREEMENT WILL BE REFUNDED TO YOU WITHIN THIRTY (30) DAYS AFTER THE EFFECTIVE DATE OF YOUR CANCELLATION.”

    Cancellation During Initial Term. During the initial term this Agreement may only be cancelled if: (1) you die, (2) you become totally disabled, or (3) you permanently move your residence more than 25 miles from an affiliated Club. Failure to use the Club does not relieve you of your obligation to pay for your membership.”
    Death. If cancellation is by reason of death, notice of the member’s death and certified copy of the death certificate must be delivered to the Customer Service Office at the address below.”
    Disability. If you are totally disabled, as confirmed by a physician acceptable to both you and the Club, you may cancel this agreement by giving 30-days written notice to the Club.”
    Relocation. If you permanently move more than 25 miles from any Club that is a member of The Seattle Gym you may cancel this Agreement by giving 30-days written notice to the Club. You must provided documentation/evidence of your move (current lease or rental agreement, newly issued driver’s license, current utility bill reflecting your name and the new address, military orders, or other evidence acceptable to the Club).”

    Other Events Triggering Your Right to Cancel. In addition to the provisions above, you may cancel your contract immediately:”
    (a) If the Club facilities are permanently closed and comparable facilities owned and operated by the”
    “Club are not made available within a ten mile radius of the closed facility.”
    (b) If a facility, construction or improvement is not completed by the date represented in this Agreement. If this contract is cancelled for either of the reasons above, you will be entitled to a refund of the un-”
    “used portion of any membership fees paid, and you will be relieved from future payment obligations.”

    Request and Effective Date of Cancellation. Your cancellation request must be completed and submitted:
    1) in person at the club or 2) via e-mail submission to: billing@theseattlegym.com or 3) your notice sent via certified mail to: The Seattle Gym, 1530 Queen Anne Ave. N., Seattle, WA 98109, and should include your membership number, current contact information (address and telephone number), your membership card, all supporting documentation. Any past due balance owing on the account must be paid in full prior to the cancellation of the membership.”
    Your cancellation will be effective thirty (30) days after the next scheduled dues payment following our confirmation of receipt of your cancellation notice and all required documents.”

    Cancellation After Initial Term Expires. You may cancel this Agreement by giving a minimum of 30-days written notice to the Club. Your cancellation will be effective thirty (30) days after the next scheduled dues payment following our receipt of your cancellation notice. I understand that my cancellation request is for my membership ONLY. I am still responsible for paying dues incurred by any additional members on my account. Any past due balance owing on the account must be made current.”

    Freeze Provisions:
    1) A member may apply for a temporary inactive membership status based upon a valid medical/injury related condition. Members may be required to submit to the Club sufficient proof/documentation of such illness or injury. There will be no monthly charges during the temporary freeze period.”
    2) A member may apply for a temporary inactive membership status for any situation other than for medical/injury related condition. The membership will be in a temporary maintenance status where it is kept active and in good standing. The Club may, at its sole discretion, approve or reject any application for inactive membership. Members applying for inactive status must be current in their account. The EFT dues for those months will be reduced to $10/month during the temporary freeze period for maximum of 3 months during a calendar year.”


    ENTIRE AGREEMENT. This Agreement constitutes the entire agreement and understanding between you and the Club. Anything communicated to you verbally is not valid unless it is contained in this Agreement. If we breach this Agreement, your only remedy and recourse will be to cancel your membership.”

    FEE INCREASES. After the initial term of this contract expires, we may from time to time increase your monthly membership fees. If we choose to increase your membership fees, you will have the right to cancel your membership within 30 days.”

    “+ All EFT membership plans are subject to an annual maintenance/banking service fee on July 1st regardless of the date of membership sign up.”


    RETURNED CHECKS AND DRAFTS. We assess a $20 NSF service charge for returned drafts and checks. Further, if we are unable to process a check or credit card draft the first time, we may place your account on a manual billing status. Accounts that must be billed manually are assessed service fee of $20.00 per month. I understand that it is my responsibility to notify and update my billing information with the Club, in a timely manner to avoid any service charges.”


    LATE PAYMENTS; DEFAULT. We will assess a $20 late fee for any amount not paid when due. In addition, balances more than 30 days past due will accrue interest at the rate of 1.5% per month. If you are unable to pay any amount under this contract by its due date, please contact your Club immediately so that other payment arrangements can be made. If you fail to make any payment due under this Agreement, the entire balance under this Agreement may become due immediately, and you will be required to pay all costs of collection, including collection agency fees, court costs and attorney fees.”


    TRANSFERABILITY. Your Club membership may not be transferred.”


    LIABILITY WAIVER AND HOLD HARMLESS AGREEMENT
    “I understand and agree that neither The Seattle Gym, nor any of its owners, officers, employees, or agents may be held liable FOR, and I hereby personally assume all risks arising from any occurrences, acts, omissions, or conditions in connection with the use of the facilities, equipment, or services of The Seattle Gym, that may result in injury, death, or other damages to me, my heirs, or assigns, whether said risks are foreseeable or unforeseeable, AND WHETHER SAID INJURY, DEATH OR OTHER DAMAGE IS THE RESULT OF NEGLIGENCE ON THE PART OF ANY OWNER OFFICER, EMPLOYEE, AGENT OR CUSTOMER OF THE SEATTLE GYM and further save and hold harmless The Seattle Gym, its owners, officers, employees, or agents from any claim by me, my family, estate, heirs, or assigns.”

    “I have fully read and understand the contents, terms, and conditions of this waiver of liability and Hold Harmless Agreement. I have had adequate opportunity to consult with an attorney OF MY CHOOSING concerning this Waiver of Liability and Hold Harmless Agreement. I am of lawful age, am legally competent, and sign this document of my own free will.”

    ACKNOWLEDGMENT AND ASSUMPTION OF RISKS
    “I hereby acknowledge that engaging in physical exercise, including the use of exercise machines, free weights, club facilities, training and instruction could cause me physical harm. I voluntarily participate in these activities and assume all risk of physical harm that might result. I represent I am fully capable of participating in these activities without causing harm to me or to others. I acknowledge that the staff of the Club is, and have been available to answer questions about the nature and physical demands of these activities and the risks, hazards and dangers associated with them. I understand that the presence of The Seattle Gym personnel is absolutely no assurance of my safety or the reduction of any of these risks.”

    RELEASE AND INDEMNITY AGREEMENT
    “I agree to release and covenant not to sue the Club, with respect to all claims, liabilities, suits or expenses (including attorney fees and costs), arising out of any injury, damage or other loss to me in any way connected with my use of the Club’s facilities or participation in its programs. The SeattleGYM will be filming select, scheduled classes for public release. Any workout that is being filmed will be posted in advance on the schedule board and TSG website. PARTICIPATION IS YOUR CONSENT TO BE RECORDED FOR POSSIBLE PUBLIC RELEASE.”


    CLUB RULES
    “You agree to be bound by The Club Rules and Regulations regarding member’s use of the facilities to enhance a pleasant experience for all members. These Rules should be considered a part of your Membership Agreement. From time to time the Club may adopt and post additional rules.”
    Sign-in. All members/guest are required to check in at every visit by scanning your membership card at the check-in counter. If a you don’t have a valid, bar-coded membership card, or your photo image is not on record, please sign in and show photo ID to the front desk staff.”
    Hours. Our hours and days of operation will be posted on the premises and may change from time to time in consideration of holidays, seasons, member usage and maintenance requirements.”
    Member Conduct. Because we’re concerned about your health, we require that you refrain from smoking or using tobacco products, alcohol or illegal drugs at the Club. It is our policy to expel members who may be under the influence of drugs or alcohol. We also ask that members treat one another with respect and that they refrain from using course or derogatory language. Please keep cell phone usage to a minimum and only in the allowed areas.”
    Locker and Locker Rooms. Lockers and locker rooms are provided for your convenience. Lockers, however, are for day use only. We empty lockers every night and, if necessary, we will remove any unauthorized locks. Locker contents will be discarded or donated to charity. We are not responsible for lost or damaged articles. No cell phone usage in locker rooms.”
    Dress Code. Please wear workout attire appropriate for a public environment where men, women and minors may be present. Closed-toe shoes are required.”
    Guest Privileges. We invite you to bring guests to visit the Club, however, guests will be subject to our customary guest fee. Guests are admitted to the Club at the discretion of the management and must comply with all Club rules.”
    Peak Hours. You should be aware that the Club has peak hours of usage when facilities and equipment and services may not be as available as you would like. If you would like to avoid peak hours, speak with a Club staff member to determine the best hours for you.”
    Violation of Rules. If a member fails to comply with Club rules, we reserve the right to terminate his/her membership privileges. Any such termination, however, will not relieve the member of his/her obligation to pay the unpaid portion of his or her membership fees.”
